Serving notice of your planning application
If you are not the sole owner of the site that your planning application relates to, you need to serve notice to those affected.
The type of notice you need to serve depends on the type of application you are submitting and who owns the land that your application relates to.
Serving notice as part of a new planning application
As part of your application for planning permission, you must prove your ownership of the site that your proposal relates to by completing one of 4 certificates.
The notice you must serve depends on which certificate you complete.
If you are the sole owner
You will complete Certificate A if:
- you are the freeholder of the land
- there are no leaseholders with 7 years or more remaining on their lease
- your proposal does not encroach on anyone else's land
You do not need to serve notice.
If you share ownership and you know all the other owners
You will complete certificate B if you share ownership of the land and you know who all the other owners are.
If the application relates to a householder development, you need to complete the notice under Article 11 (PDF) [77KB] for householder development and send it to all known owners.
For all other developments, you need to complete notice 1 under Article 14 (PDF) [104KB] and send it to all known owners.
If you share ownership and you know some of the other owners
You will complete certificate C if you share ownership of the land and you know some of the other owners.
If the application relates to a householder development, you need to complete the notice under Article 11 (PDF) [77KB] for householder development and send it to all known owners.
For all other developments, you need to complete notice 1 under Article 14 (PDF) [104KB] and send it to all known owners. You also need to complete notice 2 under Article 14 (PDF) [104KB] and publish it in a local newspaper.
If you share ownership and you do not know any of the other owners
You will complete certificate D if you share ownership of the land and you do not know any of the other owners.
You need to complete notice 2 under Article 14 (PDF) [104KB] and publish it in a local newspaper.
Serving notice as part of an application to make a non-material amendment
If you already have planning permission for the site you plan to build on and you are completing an application to make a non-material amendment to your planning permission, you need to complete the notice under Article 10 (PDF) [166KB] and serve it to:
- any owners of the land who would be affected by the amendment
- any tenants of the land if it is an agricultural holding
