Parking waiver terms and conditions
Introduction
A waiver may be issued to allow specified vehicles to park where waiting restrictions apply at a specified location. It is not a general dispensation to park illegally.
The Council may exercise its discretion and issue waivers only in exceptional circumstances, where it is deemed that the vehicle is required to park near to or adjacent to a specified property. The decision made by the Council will be final, and where any application is rejected, the contractor shall make alternative parking arrangements.
Conditions Part 1
A waiver for parking on single or double yellow lines, in pay and display or resident's bays is only issued where the vehicle is necessary for the completion of the task at hand. A waiver will not be issued where tools and materials can be unloaded from the vehicle.
The following list shows examples of reasons a vehicle would be eligible for a waiver.
- The vehicle is a mobile workshop with a workbench and tools that are fixed to the vehicle and cannot be unloaded. This must be necessary for the work.
- The vehicle has a generator fixed to the vehicle that is required to power tools that are necessary to complete the work.
- There is a pump fixed to the vehicle, which is required to complete the work.
- There is a fixed gas supply, or where the gas tanks are too large to remove from the vehicle, and this supply is required for the work at hand, e.g. For welding or refilling fire extinguishers hazardous materials - chemicals that are officially a danger to health, present in large quantities and where there is insufficient secure storage for them on the site. Asbestos removal would also qualify, where full precautions including on site wash down facilities are required.
- Where space is very restricted and there is no space available to offload materials or store debris until a load is ready. A waiver for this reason would only be issued after a site inspection to confirm that the waiver is necessary.
The vehicle must be moved once the work is complete and the vehicle is no longer required. The Council is not required to provide waivers for vehicles to park in the vicinity of their permanent or regular place of work.
This service is provided to assist bona fide operations for contractors and individuals where it is necessary for a vehicle to be parked otherwise in contravention of parking regulations.
Payment is £10 per day or part of day, £50 for up to 1 week, £75 for up to 1 month and £200 for the year. This does not include the first day if after 6pm or the final day if cleared by 8am.
At certain locations the waiver may not be valid for the full day. Waiting restriction for peak flow traffic movement would be such a location where it's waiver would not be valid for part of the day.
Conditions Part 2
In some instances, funerals, statutory duty, and the like of the waiver may be without charge. The duration of the waiver can be extended by advance notification and payment to the parking office.
The Council reserves the right to refuse to issue a dispensation and takes into consideration, safety of other road users and pedestrians and previous misuse of a dispensation covered by these terms and conditions.
Civil Enforcement Officers employed by the Council will observe the vehicle to establish whether it is necessary for that vehicle to be in that location. Materials or goods must not be deposited on the footway or carriageway (except to the immediate rear of the vehicle on street or to the immediate bay next to the vehicle in a car park); nor shall they be passed across any part of the footway or carriageway in any manner which may interfere with the safety of pedestrians and or of any vehicles.
Should it be deemed that the vehicle is causing an obstruction to pedestrian or vehicular traffic flow or that it is considered unnecessary for it to be parked there; the driver will be requested to move the vehicle. This request may come from a Civil Enforcement Officer or Police Officer in uniform.
Note that the dispensation applied by the waiver will have no effect in any other parking place, and the conditions imposed in that parking place must be adhered to, including the payment of any parking charge. Should the vehicle be asked to move on, the Council are not required to offer any alternative parking place and the waiver shall be deemed invalid. The holder of the waiver may claim a refund for full or part days paid for. On instruction to remove the vehicle from the specified location, the waiver shall be deemed to have been revoked and a Penalty Charge Notice may be incurred should the driver not follow the instructions issued by a Civil Enforcement Officer or Police Officer in uniform.
A waiver does not give the driver the right to park in; Taxi Ranks, Disabled Persons Parking Bays, Bus Stop Clearways, Loading Only Bays, Police Bays or on School Keep Clear markings unless specifically authorised. Should a waiver be issued for parking in any Pedestrian Zone, the driver will be responsible for obtaining authorisation from Cleveland Police for access into the Pedestrian Zone during restricted hours.
